Welcome to PurePath Dynamics. These Terms of Service ("Terms") govern your access to and use of the PurePath Dynamics mobile application, software, and related athletic analysis services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
1. Acceptance of Terms
By creating an account, uploading media, or otherwise utilizing PurePath Dynamics, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. You must be at least 13 years of age (or the minimum legal age in your jurisdiction) to use the Service.
2. Description of Service
PurePath Dynamics provides advanced athletic movement and form analysis tools for sports training, including baseball, softball, football, basketball, soccer, and golf mechanics. The Service utilizes cutting-edge artificial intelligence models to process user-submitted video footage, evaluate athletic form, and deliver structural feedback and data analytics.
3. User Content and Responsibilities
Ownership: You retain all ownership rights to the video content, images, and data you upload or record through the Service ("User Content").
License to Process: By submitting User Content, you grant PurePath Dynamics a worldwide, non-exclusive, royalty-free license to process, analyze, and render your video exclusively for the purpose of delivering athletic form analysis and generating reports.
Lawful Use: You represent and warrant that you own or have the necessary rights to all User Content you upload, and that your videos do not violate any applicable laws or the privacy rights of third parties.
4. Data Privacy and Video Deletion Policy
Temporary Processing: Videos uploaded for analysis are processed securely to generate your performance feedback.
Automated Deletion: To protect your privacy, temporary video files and local working cache are automatically deleted immediately after a successful response from our analysis engine is safely saved to your account history.
Local Rendering: Certain rendering and export functions utilize your device's local processing power and storage via local rendering engines to assemble exported analysis files.
5. Intellectual Property
Platform Rights: All software, design architecture, AI analysis frameworks, trademarks, and branding elements associated with PurePath Dynamics are the exclusive property of PurePath Dynamics.
6. Assumption of Risk, Disclaimers, and Limitation of Liability
Assumption of Risk: You acknowledge and agree that participation in physical sports, athletic training, and movement drills (including baseball pitching, football throwing, golf swings, and general athletic conditioning) involves inherent risks of serious injury, illness, or death. You voluntarily assume all risks, whether known or unknown, associated with performing any exercises, mechanics, or movements suggested, evaluated, or reviewed by the Service, even if caused entirely or in part by the negligence, fault, or oversight of PurePath Dynamics or its artificial intelligence models.
Use at Your Own Risk: Your use of the Service, including the implementation of any form corrections, data analytics, or training recommendations, is entirely at your own risk. You are solely responsible for evaluating your own physical fitness, consulting with a qualified physician before starting any training program, and ensuring that your training environment, equipment, and physical capacity are safe.
Release of Liability for Injury and Damages: To the fullest extent permitted by applicable law, you hereby release, waive, and forever discharge PurePath Dynamics, its officers, directors, employees, and agents from any and all claims, liabilities, demands, or causes of action for any personal injury, property damage, or financial loss arising out of or connected to your use of the Service or the execution of any athletic movements analyzed within the app.
"As Is" Basis: The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
Limitation of Financial Liability: To the maximum extent permitted by law, PurePath Dynamics shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of your use of the Service.
7. Changes to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the app or via other communication channels. Your continued use of the Service following the posting of revised Terms constitutes your acceptance of the changes.
